Terms of Service
1. Acceptance of Terms
By accessing or using the Forge AI Platform ("Service"), operated by Oxytal Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all users, including organisation administrators, invited team members, and pipeline operators. Your continued use of the Service constitutes acceptance of any updates to these Terms.
2. Service Description
Forge is an AI-powered software development lifecycle (SDLC) platform that automates and orchestrates development workflows including requirements extraction, architecture design, code generation, code review, build, deployment, and monitoring through a configurable pipeline of AI agents.
The Service integrates with third-party platforms including but not limited to:
- Anthropic Claude API (AI generation and analysis)
- GitHub (version control and pull requests)
- Atlassian Jira and Confluence (project management and documentation)
- Vercel (deployment and hosting)
- Slack (notifications and collaboration)
We do not guarantee uninterrupted availability of third-party integrations and are not responsible for outages or changes to their APIs.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:
- Provide accurate, current, and complete information when creating an account
- Promptly update your account information if it changes
- Notify us immediately of any unauthorised use of your account
- Not share your account credentials with any third party
- Not create accounts for automated bots or non-human entities without our written consent
Organisation administrators are responsible for managing access for their team members and ensuring compliance with these Terms across their organisation.
4. AI Usage & Data
The Service uses AI models (primarily Anthropic Claude) to process your inputs and generate outputs. You understand and agree that:
- AI-generated code, documents, and other outputs may contain errors and must be reviewed by qualified professionals before use in production
- You are solely responsible for reviewing, testing, and validating all AI-generated outputs
- Content you submit to the Service (Confluence pages, Jira stories, repository code) may be processed by Anthropic's API according to Anthropic's Privacy Policy
- We do not use your data to train our AI models
- Token usage and associated costs are tracked and attributed to the user who initiates each pipeline run
5. API Credentials
To use the Service, you must provide your own API credentials for the AI provider (Anthropic) and optionally for integrated third-party services. Regarding your credentials:
- Your Anthropic API key is stored encrypted in our database and associated with your individual user account, never shared across users
- You are responsible for all API costs incurred using your credentials through the Service
- You must not share credentials that exceed your authorisation under the third-party service's terms
- We recommend rotating credentials periodically and immediately upon suspected compromise
- We are not responsible for charges incurred on third-party platforms as a result of your use of the Service
6. Intellectual Property
The Service, including its design, code, documentation, and branding, is owned by Oxytal Ltd and protected by intellectual property laws.
Your content: You retain ownership of all content you input into the Service, including Confluence pages, Jira stories, and repository code. You grant us a limited licence to process this content solely to provide the Service.
AI-generated outputs: Code, designs, and documents generated by the Service using your inputs are considered work product for your use. We make no claim to ownership of AI-generated outputs derived from your content.
Feedback: If you provide feedback or suggestions about the Service, we may use this information without obligation to you.
7. Acceptable Use
You agree not to use the Service to:
- Generate malicious code, malware, exploits, or security vulnerabilities
- Violate any applicable law, regulation, or third-party rights
- Circumvent API rate limits or usage policies of integrated third-party services
- Attempt to reverse-engineer, decompile, or extract source code of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to process classified, export-controlled, or highly sensitive personal data without appropriate safeguards
- Resell or sublicence access to the Service without our written consent
8. Payment & Billing
The Service may be offered on a subscription basis or with usage-based pricing. Where applicable:
- Subscription fees are billed in advance and are non-refundable except where required by law
- Usage-based charges (API token costs) are your responsibility and billed through your own API provider accounts
- We reserve the right to modify pricing with 30 days notice
- Failure to pay may result in suspension or termination of your account
The cost dashboard within the Service provides estimates only. Actual costs are determined by third-party API providers.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability to you for any claims arising from use of the Service shall not exceed the amounts paid by you in the twelve months preceding the claim
- We are not liable for any errors in AI-generated code or content that you deploy to production systems
10. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms or if required by law. Upon termination:
- Your access to the Service will cease immediately
- We will retain your data for 30 days to allow export, after which it may be permanently deleted
- Provisions that by their nature should survive termination (including IP, liability limitations, and governing law) shall survive
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction apply.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or via an in-app notification at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
